In these terms, “investorbet”, “we”, “us” and “our” mean investorbet Ltd. “HRBC” means the Horse Racing Bettors Companion website, software, data, research tools and associated services.
1. Agreement
By creating an account, purchasing a subscription or using HRBC, you agree to these Terms of Use together with our Data Protection Statement and Cookies Policy.
If you purchase a subscription, you also agree to the subscription terms set out below.
If you do not agree to these terms, you should not use HRBC.
2. What HRBC is
HRBC is a collection of horse-racing information, research and analytical tools designed to help users investigate races and runners.
Depending on your subscription package, HRBC may provide access to features including:
- racecards;
- RFMS rankings;
- RSPD speed measures;
- historical win and place statistics;
- recent form;
- horse comparisons;
- jockey and trainer research;
- pedigree and offspring research;
- early pace and finishing-style information;
- race comments;
- racing results and reporting;
- bet tracking;
- bookmarks and notes;
- personal notebooks;
- educational material; and
- other horse-racing research tools.
The features available, the level of detail provided and the amount of historical information accessible may vary according to your subscription package.
Our Features and Subscriptions pages describe the packages currently available.
We may develop, replace, improve or discontinue individual features over time.
3. What HRBC does not do
HRBC is a research toolbox.
It does not place bets for you, hold betting funds, operate a betting account on your behalf or decide which bets you should place.
Rankings, ratings, statistics, historical results, race comments, comparisons and other information supplied through HRBC are tools for your own research.
You remain responsible for deciding:
- whether to place a bet;
- which selection to make;
- where to place it;
- what price to accept; and
- how much, if anything, to stake.
HRBC does not guarantee that any horse will win, be placed or finish in any particular position.
Analytical data can provide a guide to the future by allowing us to compare current conditions with the past, but it cannot guarantee where a horse will finish in any given race.
4. Historical and analytical information
Much of HRBC is based on historical racing information.
Historical patterns, percentages, rankings and statistics describe or analyse information available from previous races. Racing conditions, horses, participants and circumstances change.
Historical information should therefore be treated as research evidence rather than a guarantee of what will happen in a future race.
Some HRBC information is generated or classified automatically from underlying racing data. For example, analytical tools may interpret race comments to identify characteristics such as early pace or finishing style.
These are analytical interpretations of the available source information and should be considered alongside the other evidence available to you.
5. Eligibility
You must be at least 18 years old to create an HRBC account or purchase a subscription.
You are responsible for ensuring that your use of HRBC and any betting activity you undertake complies with the laws applicable to you.
We may refuse, restrict, suspend or terminate an account where we reasonably believe that a user is under 18, has provided false information, is misusing the service or is otherwise in breach of these terms.
6. Your account
You must provide accurate information when creating and maintaining your HRBC account.
You are responsible for keeping your login credentials secure and should not allow another person to use your account.
You are responsible for activity carried out through your account unless the activity results from a security failure for which we are responsible.
If you believe somebody else has gained access to your account, contact us promptly.
An HRBC account and an HRBC subscription are separate.
Your account may continue to exist after a subscription has ended so that you can subsequently resubscribe and, where applicable, retain information associated with your account.
7. Subscription packages
HRBC currently offers subscription packages with different levels of access.
Current package features and prices are shown on the Subscriptions and Features pages.
The package displayed as active on your account determines the subscription features available to you.
Subscriptions may be offered with monthly, quarterly or annual billing.
The applicable price and billing period will be shown before you make payment.
8. Automatic renewal
HRBC subscriptions renew automatically at the end of the selected billing period unless cancelled before renewal.
For example:
- a monthly subscription normally renews monthly;
- a quarterly subscription normally renews every three months; and
- an annual subscription normally renews annually.
The renewal price and frequency applicable when you subscribe will be shown during the subscription process.
Where we propose a change to the price of an existing subscription, we will provide appropriate notice before the new price applies.
9. First subscription — 14-day cancellation and refund
When you purchase your first paid HRBC subscription, we provide a 14-day cancellation period.
Your HRBC access begins immediately after successful payment and activation.
If you cancel your first paid subscription within 14 days of that subscription beginning, you may request a refund of the initial subscription payment.
Your paid access may end when that refund is processed.
This 14-day refund arrangement applies to the initial purchase of your first HRBC subscription. It does not create a new voluntary 14-day refund period each time an existing subscription renews.
Nothing in these terms limits any consumer right that cannot lawfully be excluded.
10. Cancellation after the initial 14 days
After the initial 14-day period, you may cancel your subscription at any time.
Normal cancellation takes effect at the end of the subscription period you have already paid for.
For example, if you have a monthly subscription and cancel halfway through the month, your package normally remains available until the end of that paid month. No further renewal payment will then be taken.
The same principle applies to quarterly and annual subscriptions.
Payments already made are not normally refunded or apportioned for unused time because your subscription remains available until the end of the period purchased.
This does not affect any refund or other remedy to which you are entitled by law.
11. Upgrading your package
You may upgrade to a higher HRBC package.
Where available, you may be given the choice to:
Upgrade immediately
Your higher package begins once the additional payment required for the remainder of your existing billing period has been successfully collected.
The additional amount will normally be calculated on a pro-rata basis. Your existing renewal date normally remains unchanged, and subsequent renewals will be charged at the applicable price for the higher package.
or:
Upgrade at your next renewal
Your existing package continues until the renewal date. The higher package then begins and the applicable subscription price is charged.
The price and effective date will be shown before you confirm the change.
12. Downgrading your package
A downgrade to a lower HRBC package normally takes effect at your next renewal.
Your existing package remains available until the end of the period for which you have already paid.
No pro-rata refund or credit is normally given for a scheduled downgrade because you retain access to your existing package until that period ends.
At renewal, your subscription changes to the selected lower package and the applicable subscription price is charged.
13. Changing billing frequency
Where HRBC allows you to change between monthly, quarterly and annual billing, the change will normally take effect at your next renewal.
Your existing paid billing period remains unchanged until then.
The new billing period and applicable price will be shown before you confirm the change.
14. Payments
Subscription payments are processed using Stripe.
Your card details are collected securely by Stripe. investorbet does not store your complete card details on its own systems.
Your use of Stripe's payment services may also be subject to Stripe's applicable terms and privacy arrangements.
A subscription is not considered successfully activated or renewed until the required payment has been confirmed.
15. Failed payments
If a subscription payment fails, we may restrict or suspend paid HRBC features until payment is successfully completed.
A failed subscription payment does not normally delete your HRBC account or your personal research records.
Where possible, you may be given an opportunity to update your payment details or otherwise resolve the failed payment.
16. Availability of racing information
HRBC relies on racing information and other data that may originate from third-party sources.
We aim to keep information current and make HRBC available reliably, but we cannot guarantee that every racecard, result, price, non-runner, statistic or other item of information will always be complete, accurate or available at a particular moment.
Racing information can change quickly.
Racecards may change because of withdrawals, declarations, going changes or other circumstances. Results and other information may also be corrected or updated after initial publication.
Users should take this into account when conducting their research.
17. Service availability
We aim to provide a reliable service but cannot guarantee uninterrupted availability.
HRBC may occasionally be unavailable or partially unavailable because of maintenance, software updates, technical problems, third-party outages, data-provider problems, internet failures or circumstances outside our reasonable control.
We may carry out maintenance and development where reasonably necessary to operate, secure or improve the service.
18. Personal research tools
HRBC may allow you to store personal information such as:
- bet-tracker entries;
- bookmarks;
- racing notes; and
- notebook content.
These facilities are intended as convenient research tools.
You should not use them as the sole repository for information that is particularly important to you.
We take reasonable steps to operate and protect our systems, but no online storage service can guarantee permanent availability or preservation of every user-created record.
19. Bet Tracker
The HRBC Bet Tracker is a personal record-keeping tool.
Entering a bet into the Bet Tracker does not place that bet with a bookmaker, betting exchange or any other gambling provider.
HRBC does not transmit Bet Tracker entries to bookmakers or exchanges.
Calculations shown in the Bet Tracker are intended to help you record and review your own betting activity.
You remain responsible for checking your actual betting-account transactions and balances with the relevant bookmaker or exchange.
20. Acceptable use
You must not misuse HRBC.
In particular, you must not:
- attempt to gain unauthorised access to HRBC, another user's account or our systems;
- interfere with the security or operation of the service;
- knowingly introduce malware or harmful code;
- create accounts fraudulently or impersonate another person;
- use automated systems to scrape, harvest or systematically extract HRBC data without our written permission;
- attempt to bypass subscription restrictions or package-access controls;
- share account credentials to provide subscription access to other people;
- reproduce or commercially redistribute substantial parts of HRBC's data, analysis or software without permission; or
- use HRBC in a way that infringes our rights or the rights of another person.
Reasonable personal use of the research information available through your subscription is permitted.
21. Intellectual property
HRBC's software, branding, page designs, analytical methods, presentation, written material and other original content are owned by investorbet Ltd or used under licence.
Third-party racing information remains subject to the rights of its respective owners and licensors.
Your subscription gives you a limited, personal, non-exclusive and non-transferable right to use HRBC for your own purposes while you have the appropriate access.
It does not transfer ownership of HRBC software, databases, analytical methods or other intellectual property to you.
You must not copy, reproduce, sell, license, redistribute or commercially exploit HRBC or substantial parts of its content except where permitted by law or expressly authorised by us.
22. Third-party services and websites
HRBC may contain information about or links to bookmakers, betting exchanges, payment providers and other third-party services.
Those organisations are independent of investorbet Ltd.
We do not control their websites, prices, markets, account decisions, availability, settlement procedures or other services.
If you choose to use a third-party service, your relationship with that provider is governed by its own terms.
23. Betting and personal responsibility
Horse-racing betting involves the risk of financial loss.
HRBC provides research tools and information. It does not control the outcome of races or the decisions you make after conducting your research.
You are responsible for your own betting decisions and for deciding whether betting is appropriate for you.
Never bet money you cannot afford to lose.
24. No professional advice
Nothing provided through HRBC constitutes legal, tax, financial or regulated investment advice.
HRBC's horse-racing information and analytical tools are provided for research and informational purposes.
Where you require professional advice about your personal circumstances, you should obtain it from an appropriately qualified person.
25. Liability
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any consumer right or other liability that cannot legally be excluded.
Subject to those protections, investorbet Ltd is not responsible for betting losses or other losses resulting from a user's decision to place, alter or refrain from placing a bet on the basis of information considered through HRBC.
We are not responsible for losses caused by circumstances outside our reasonable control, including failures of third-party racing-data services, bookmakers, betting exchanges, payment providers or internet services.
Nothing in these terms affects your statutory rights as a consumer.
26. Suspension and termination
We may suspend or restrict access to an account where reasonably necessary because of:
- non-payment;
- suspected fraud;
- security concerns;
- misuse of HRBC;
- breach of these terms; or
- activity that may damage HRBC, investorbet Ltd, our suppliers or other users.
For serious or repeated breaches, we may terminate an account.
Where appropriate and reasonably possible, we will explain the reason for the action and what, if anything, you can do to resolve it.
Suspension or termination by us does not affect consumer rights that cannot lawfully be excluded.
27. Data protection
We process personal information in accordance with our Data Protection Statement.
This explains what information we collect, why we collect it, how it is used, how long it may be retained and the rights available to you.
investorbet Ltd is registered with the Information Commissioner's Office under registration reference ZC251966.
28. Cookies
HRBC uses cookies and similar technologies where necessary to operate the website and, where applicable, for other purposes explained in our Cookies Policy.
Please see the Cookies Policy for further information.
29. Changes to HRBC
HRBC will continue to be developed.
We may add, modify, replace or remove features where reasonably necessary to develop, maintain or improve the service.
We will not deliberately use minor product changes as a means of depriving customers of the substance of a subscription they have already purchased.
Where a change materially affects a paid subscription, we will deal with it reasonably and in accordance with applicable consumer law.
30. Changes to these terms
We may update these Terms of Use from time to time, for example because HRBC changes, our commercial arrangements change or the law changes.
The current version will be published on the website with its latest revision date.
Where a change materially affects an existing paid subscription or your rights, we will provide appropriate notice where required.
31. Governing law
These Terms of Use are governed by the law of England and Wales.
If you are a consumer living elsewhere in the United Kingdom, you retain any mandatory rights and protections applicable to you and may have the right to bring proceedings in the courts where you live.
Nothing in these terms is intended to restrict rights that cannot lawfully be restricted.
